I,
C.Natesan, was appointed as Secondary Grade Middle School Head Master in Kasthuri Palayam
Panchayat Uinon Middle School in
Uttukuli Panchayat Union on 24.09.1964. And I was posted as Primary School Head
Master on16.07.1965. After acquiring M,A., B.Ed., qualification I was again
promoted and served as Middle School B.T. Head Master from 11.12.1981 and retired from service on
30.06.2001.So, As on 01.06,1988 I was
working in the post of Middle School Head Master.
I became Middle School B.T. Head Master on
11.12.1981 and I am entitled to Special
Grade, by counting the service as
Secondary Grade Middle School Head Master/Primary School Head Master, from
01.06.1988 based on G.O.Ms.No.210 Dated 14.08.2009 as there was Pay Revision
with effect from 01.06.1988.
When I applied for Special Grade and
Scale of Pay In the post of Middle School Head Master, it was not considered.
So. I filed W.P.No.3236 of 2012 and M.P.No.1 of 2012. In this Writ Petition, Honorable
Mr.JUSTICE D. HARI PARANTHAMAN Pleased
to deliver the following Judgment on 18.06.2015.
“ 11. For the afore said reasons , the
petitioner shall be granted Selection Grade/Special Grade Pay in the post of
Middle School Head Master , by counting the service rendered as Secondary Grade Teacher/ Primary School
Head Master/Elementary School Head Master, from the date his promotion to the post of Middle School Head Master,
if he petitioner was not given the same
already., with all monetary benefits and the pensionary benefits with arrears
with in a period of four weeks from the date of receipt of this order. In the
light of the aforesaid
But Education Department preffered an appeal
against this Judgment So, I moved the
High Court in W.A.No.691/2017.
In this appeal Honorable Judges of High
Court delivered the Judgment on
03.01.2019.and passed the following order to the appellants,
“…….to direct the appellants to
fix the pay in the Selection Grade / Special Grade with in a period of Four Weeks from the date
of receipt of the copy of the Judgment
and Consequently, the appellants are further directed to revise the Pension/Family Pension and disburse
both arrears of salary and differential pension within a period of eight weeks there
after, Consequently connected civil miscellaneous petitions are closed. No costs’
But even after the receipt of the judgment
, Special Grade Pay in the post of
Middle School Head Master from 01.06.1988 was not fixed and the
Pension also was not revised for
me and both arrears of salary and differential pension are not paid to me.
Hence I pray the High Level Monitoring Committee to
take suitable actions to implement
the High Court Judgmenet as soon as
possible.
